Facts

Porter (P) sustained damage in an automobile collision involving a motorist insured by Carriers Insurance (D). Crawford & Company (D1), acting as an adjuster and agent for D, settled P's claim. After P deposited the check in his bank, D stopped payment without informing P. P's checks were returned for insufficient funds. P sued D for recklessly stopping payment and D1 for failing to inform P of the stop payment order. The trial sustained a motion to dismiss all counts. P appealed.
