Facts
Proctor (D) was charged with keeping a place with the intent of selling alcoholic beverages. This was against state laws. Neither D nor the state alleged that he actually sold liquor at that location. D was convicted. The lower court held that the thought of selling liquor was the same as the crime for selling liquor. D appealed.
