Hands (D) put a slug into the slot of a cigarette machine to obtain cigarettes without having to pay for them. D was supposed to put pennies into the machine to pay for the cigarettes. D took the cigarette and carried it away as if he had properly purchased it. D was indicted for the larceny of the cigarette. D appealed his conviction, claiming that his acts did not constitute larceny.
