Facts

Howe (D) was prosecuted along with three other compatriots for various crimes including the murder of a 19-year-old youth. D strangled the victim on orders from another compatriot named Murray. D claimed that if he did not comply, Murray would have beaten him to death. D claimed duress and this issue was certified to the House of Lords.
