Near the expiration of the applicable New Jersey statute of limitations, Ps filed diversity libel actions misnaming 'Fortune' as the defendant. After the statute had run, P served amended complaints on Fortune also known as Time, Incorporated. The lower court dismissed the action and P appealed.
