Moore (D), D/B/A D entered into an agreement with P for the supply of natural gas services at property owned and/or controlled and/or managed by Ds. P supplied the gas on a monthly basis and D accepted the deliveries. P sent monthly invoices to D between July 1, 2014, and June 2015 for services rendered and D make any payments. P alleged in his complaint damages and unjust enrichment that Ds and/or collectively own the Holiday Inn Hotel where the gas was delivered and used. The last issue the court discussed was whether Moore (D) should be held personally liable for any damages imposed.
