Facts

State (P) alleged a violation by A.N.W. (D) of the Consumer Protection Act. A default judgment was entered against D. Denial of D’s motion to vacate was followed by an appeal. P obtained a writ of execution. The sheriff proceeds were $16,588.50. Six months later the Court of Appeals vacated the default judgment. D then moved for an order or restitution. The fair market value of the property was set at $57,631.50. The Court of appeals affirmed. This appeal resulted.
