On January 11, 1991, Milton Fox (D) was charged with possession of ephedrine. Possession of ephedrine has been illegal in Idaho since 1988. D received 100,000 tablets of the substance via an out of state mail order catalog. D claimed that since he did not know that ephedrine was an illegal substance, the mens rea element of his crime was never satisfied.
