Hallett (D) and Felsh left a party after they had become intoxicated. They proceeded to an intersection regulated by two opposing stop signs and bent one over so that it was not visible to oncoming traffic. They removed the other sign completely. The next morning a fatal accident occurred because of the 'missing' signs. D was convicted of negligent homicide; his removal of the signs was the proximate cause of the death. D appealed; D's negligence was superseded by the negligence of one of the drivers in driving over the speed limit.
