D went to a friend's house to hang out. D was sick, and his friend fixed him a special coffee drink with a minty taste. His friend told D it was a home remedy. D claims he did not know that the coffee drink contained any alcoholic beverage. D was arrested for Driving Under the Influence of Intoxicants (DUII). D's defendant's blood alcohol content (BAC) was 0.12 percent. During trial, D presented his defense hoping the court would read into the statute some culpable mental state. The court refused, and D was convicted. The Court of Appeals affirmed by declining to reconsider its decisions holding that DUII is a strict liability crime. D appealed.
