Facts
Mitchell (D) went to the home of John Warren with the intent to kill him. D fired his gun through Warren's window into Warren's bed where D believed that Warren was sleeping. Warren was not there. D was found guilty of an attempted murder. D appealed; his crime was impossible to complete.
