Facts

D is the father of J.T., J.T was a fourth-grade student at Grand Lake School. The assistant principal, Jacqueline Holmes, called J.T.'s parents to inform them that he had been sent to the office due to disciplinary problems. J.T.'s parents had a conference with Ms. Holmes, and D then checked J.T. out of school. When leaving the office, D kicked J.T. in the buttocks and then kneed him in the back. Ms. Holmes called the police. Deputy Broussard went to D's residence. While at D's residence, Deputy Broussard observed various injuries to J.T. and arrested D. Paramedics subsequently examined J.T. at the residence. D was charged in a bill of information with second-degree battery and also charged with cruelty to juveniles, a violation of La.R.S. 14:93. D entered pleas of not guilty to each charge. The trial court found D guilty of simple battery and cruelty to juveniles. D appealed.
