Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
D was charged with murder for the death of Iona Ostlund. Counsel raised the issue of D's competency to stand trial and filed a notice of defense based on mental condition. The trial court appointed three doctors and a criminal trial lawyer to examine D and render an opinion about his competency to stand trial. After a hearing, the court found that D was competent to stand trial. D demanded a bifurcated trial on whether he committed the offense and on whether he was criminally responsible for his conduct. The jury found D guilty, and, in the second phase, the jury found that he was criminally responsible. D moved for a new trial on the ground of newly discovered evidence. The trial court denied D's motion. D appealed.
