Facts
Christenson (D) started Supplies for Industry (P) and sold it to IMC and entered into an employment agreement in 1970 not to compete for three years. D worked under that agreement until IMC sold the stock to Bennett Investment Corp. in 1979. The terms of that sale included D's employment contract and D continued employment with Bennett until 1981. D then informed Bennett that he would terminate employment and Bennett informed D that they would hold him to the noncompete clause. D informed Bennett that he had received a complete release from IMC on July 8, 1980, which had discharged any claims IMC had against D. D began competing with P and P sued to enforce the contract. The injunction was granted, and D appealed.
