Facts

D agreed to sell property to P for 100 pounds in 1806. A deposit was taken, and the transaction was never closed, and as late as 1815, there was an exchange between P’s and D’s solicitors. P filed a bill for specific performance, and it averred that the contract had not been rescinded or abandoned. D plead the statute of limitations to the bill that was filed on October 15, 1825.
