Facts
Burdine (P) worked for the Department of Community Affairs (D). P sued D for an alleged failure to promote her and then a subsequent decision to terminate her based on her gender. After a bench trial, it was ruled that neither decision was based on gender. The Fifth Circuit affirmed that P was not discriminated upon based on gender for the promotion but that she had rebutted D's prima facie case of gender discrimination with respect to her termination. The Supreme Court granted certiorari.
