Facts
P sued D to stop it from using Elvis Presley's name as part of its corporate name. The estate of Elvis intervened on the part of D asserting that it had given D permission to use the name and that it had not given permission to P. The trial court determined that the estate of Elvis had the right to control his name and as such, D won. P appealed.
