Facts

Tolbert (P) was injured by defective equipment and sued Gerber (D1), the manufacturer of the defective equipment, and Voldco (D2) the installer. The jury found both defendants negligent, and P was awarded $60,572 in damages. The jury did not apportion percentages and the trial court awarded D2 100% indemnity from D1. D1 appealed.
