A railroad company (D) and a terminal company both failed to inspect a rail car before putting it in use. An employee of Unions Stock Yards (P) was responsible for moving the switching cars for D in its yard. One of the cars had a defective nut which could have been discovered by reasonable inspection. As a consequence, an employee of P was injured. P paid the damages to its employee and then sued D to recover for that expense under contribution.
