Facts

D, Jose Padilla, and Jayyousi were convicted of three counts. Count One charged D with conspiring to commit acts of murder, kidnapping or maiming outside of the United States, while committing one or more overt acts in furtherance thereof within the United States. Count Two charged Ds with conspiring to provide material support to terrorists. Count Three charged Ds with providing material support or resources or concealing the nature thereof, all while knowing or intending that they be used in preparation for, or in carrying out a violation of a conspiracy to murder, kidnap or maim on foreign soil. Ds were convicted of committing a conspiracy, the substantive and a conspiracy to commit the substantive offense. Following their convictions, Ds each filed motions seeking for judgment of acquittal. Hassoun (D) claims that the government did not adduce sufficient evidence at trial to find beyond a reasonable doubt that he harbored the specific intent to commit any of the three objects of the conspiracy to murder, kidnap or maim.
