Facts
D was convicted and appealed the sentence on the grounds that he was not competent to stand trial. The Government called D's prior counsel and an FBI agent who arrested him to refute those contentions. D objected to his former counsel being called on grounds of the attorney-client privilege. The court allowed him to testify. D appealed.
