Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Quezada was deported on April 25, 1982. Seven months later, he was arrested by the border patrol and after a bench trial was convicted of illegal reentry. To prove that he was first deported in April of 1982 the government called as its witness Agent David Meshirer who testified that he was the designated custodian of D's immigration file. The Agent then testified and produced two documents; a warrant of deportation and a letter to D in his native language warning him of the penalties for illegal reentry after deportation. The warrant of deportation is INS Form I-205. D objected. The documents were admitted. D was convicted and appealed.
