Facts

Rybicki (D) threatened two IRS agents with a shotgun as they backed D's truck out of D's driveway. D was charged with obstructing the administration of internal revenue laws. The trial court did not instruct the jury that D had to have known that the men were government agents before he could be guilty of interfering with them. D was convicted. D appealed.
