Facts
Defendant Titus was a government-employed store clerk who was taking cigarettes from his place of work and selling them for profit. After collecting his profits, Titus was reimbursing the store for the cost of the cigarettes. Titus was charged with four counts of embezzlement (three of which he successfully repaid the store for the items taken).
