This section contains the nature of the case and procedural background.
Facts
Walters (D) hatched a scheme to recruit college football players to sign professional agent contract with him. D gave 58 players cars and money to those who signed. D signed the players to a contract but dated it in the future and kept it in his safe. The players would not have been eligible under NCAA rules if their signing with D had become known. The players lied on their eligibility forms that were mailed to the NCAA. D got the surprise of his life when all but two players honored the future deals they sign with D. When none returned the cars or money given, D got violent and resorted to threats. D was convicted and appealed.
