Facts

Webster (D) was tried as an accomplice in a bank robbery. The bank robber, King, was called as a witness against D. King testified that D was not involved. The prosecution then called into evidence prior inconsistent statements of King that inculpating Webster in the crime. The court instructed the jury that the statements could be used for impeachment only. D was convicted and appealed.
