Williams (D) and Jones engaged in an argument over a photo which showed D engaged in sexual activity with Jones' girlfriend. In an attempt to get the picture, Jones took D's wallet and ran. D entered his home, called the police, and then emerged from his house to see Jones coming at him with a lead pipe. Jones swung three times, and D retreated into his house and emerged with a bow and arrow. D pursued Jones and drew the arrow and shot. Jewel Lyles, a pedestrian, was hit, she died, and her nine-month-old fetus was born alive but died seventeen hours later from the injury inflicted on the mother. D was convicted of two counts of manslaughter. D appealed the conviction of manslaughter for killing the fetus born alive.
