Facts
Youst (P) entered his horse in a race at Hollywood Park in Inglewood California. Longo (D) also entered the race. During the race, D drove his horse into P’s. D used his whip on P’s horse and caused P’s horse to lose its stride. P finished in 6th while D finished in 2nd. The racing Board reviewed the events of the race and disqualified D. This moved P into 5th place and qualified him for a purse of only $5,000. P filed an action for intentional interference with prospective economic advantage. P sought compensatory and punitive damages.
