Adkins v. Brett

184 Cal. 252, 193 P. 251 (1920)

Facts

Plaintiff (P) brought this action against the defendant (D) for the alienation of his wife's affections. The evidence against D included statements made to P by his wife, wherein the wife admitted that she had been seeing D, that D was able to give her a good time and D was not, and that she intended to continue seeing D. D objected to this evidence on several grounds, including hearsay. The jury found for P at trial, and D appeals.
