Facts

AFAPS (P) challenged a refusal for a permit to operate an AIDS hospice under the Fair Housing Act. P wanted to establish an AIDS hospice and was met immediately with a well-organized and vocal opposition from a group of Luguillo residents. Fears included spreading the disease by mosquito, flooding, pneumonia, the fear of reduced land values, and the danger to students attending a nearby school. ARPE (D) denied the permit based on zoning problems and P appealed.
