Atlantic Mobile Homes, Inc. v. Robert C. Lefever
481 So. 2d 1002 (1986)
Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
Ps obtained money judgments against Florida Mobile Home Communities, Inc. (FMHC). D is a co-partner of FMHC in a New York partnership. That partnership owns Florida Atlantic Associates and Florida Atlantic Associates Number 2. Ps were not parties to the action against FMHC, nor was the partnership itself made a party. The trial court gave D thirty days in which to pay off FMHC's debt. After thirty days, if the debt remained unsatisfied, the order authorized P to petition the court for the liquidation of FMHC's assets, including FMHC's interest in the Atlantic-FMHC partnership itself. The authority used was section 607.274 Florida Statutes (1985). D appealed.
