Facts

Avery (P) was the owner of land. Ingalls (D) acting under the direction of Spicer (D1) unlawfully entered and cut down and carried away trees on P's land. Ds defended the action by claiming fee simple in the land. The trial court ruled that for P to recover he must prove ownership of the land. Judgment went to D and P appealed.
