Facts
Daniel and Elizabeth Barnard owned a farm adjoining the land of James Barnard. James Barnard gave permission to a gas company (D) to drill for gas on his land. Before D began drilling, P objected to the proposed site as being too close to their property line, and on the ground that D would be appropriating gas from underneath their land.
