Facts

Joe and Jean (D) were married in 1954. Two girls were born from the union who at the time of these hearings were 9 and 13. Jean instituted divorce proceedings against Joe in 1960 on grounds of physical cruelty. Joe charged Jean with adultery and sought a divorce. Joe was granted the divorce. Prior to the divorce, the children were taken by Jean to Florida with her paramour, but when they returned after the divorce, the custody of the children was delivered to Joe as per the court order. Jean then returned to Florida. Jean's contacts with her children were sparse. Joe married Mary Lee (P) and the children lived with Joe and P since that time. Acrimony developed between P and Jean and P sued to adopt the children. The lower court denied the adoption and P appealed.
