Facts

Weathers (D) filed a claim against her homeowner’s insurance. P was sent to investigate the claim by American Family Insurance. P conducted a chemical analysis of debris and found accelerant present. American denied the claim. The State criminally prosecuted Weathers (D) and she was found not guilty. Weathers (D) then sued American and got $8 million in damages. D then entered the picture with its show called Hard Copy. It ran a story on Weathers (D). P was shown on the stand during the criminal trial and that clip ended with Weathers (D) stating that everyone lied. P sued Ds for false-light. In part, P alleged that no one from D ever contacted him as a source and that D also failed to investigate additional sources. As such, P claimed D acted with actual malice. At this point in the trial, D has motioned the court to reconsider its order denying D's motion for summary judgment.
