Facts

This was a multi-prime contract to build a multimillion-dollar central library on the UNC-Chapel Hill campus. Bolton was the heating and a/c contractor, and he sued the general contractor Loving in that Loving caused undue delay which prevented Bolton from completing his part of the project on time. A directed verdict was given Loving on a negligence claim. Bolton claimed that he had a cause of action under a state statute (N.C.G.S. Section 143-128). Evidence was excluded at trial regarding the opinion of the architect on who was responsible for the delays.
