Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

P became the Principal of Kozminski Community Academy, a kindergarten through eighth-grade school in the Chicago Public School system. The Local School Council (Council) is responsible for hiring, evaluating, and renewing contracts for principals in its area. D employs a Chief Area Officer to supervise the principals assigned to his or her area. D hired Coates to serve as Chief Area Officer for Area 15, making her P's supervisor. According to P, Coates immediately 'began taking steps to remove [him] from his position at Kozminski.' Coates's efforts to remove P begin in earnest around November 2010. While P was suspended with pay, the Council voted not to renew P's contract. P submitted his notice of retirement effective June 30, 2011, the end of his non renewed contract. P sued D alleged in part discrimination on the basis of age in violation of the Age Discrimination in Employment Act (ADEA). D moved for summary judgment, which the district court granted. P appealed.
