Facts

Bragg (P) sued the Metropolitan (D) streetcar company for injuries sustained when a car in which he was a passenger collided with a Missouri Pacific passenger train. During trial, D objected to a question being asked of a Dr. Snell, a medical expert who examined P and testified to have discovered deafness of the ear, impaired eyesight of his left eye, tenderness at the junction of the cervical and dorsal vertebrae and extreme nervousness and the result of those injuries being from the accident. The question was objected to as being incompetent and not a matter of expert knowledge. The jury returned a verdict in P's favor, and D appealed.
