Facts

Laker brought an antitrust action in the U.S. against British Airways, and others alleging that Ds had implemented predatory pricing on routes between the U.S. and the United Kingdom. British Airways and British Caledonian Airways then sued Laker in the High Court of Justice in London. They claimed that the fares they charged were lawful that the Laker should be enjoined from further proceedings in the U.S. It was common ground between the parties that Laker could not have taken its suit in the United Kingdom.
