Broyles v. Commonwealth
267 S.W.2d 73 (1954)
Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
Broyles (D) was charged with the murder of Billy D. Smithers. During trial, D introduced several witnesses who testified that his reputation for peace and quietude was good. On cross the prosecution then asked each of the witnesses if they knew that D had been arrested and convicted on separate occasions for drunk driving, reckless driving, and disorderly conduct. D objected and contends that these questions were improper for cross-examination because they related to a character trait not involved in the crime of murder. D was convicted and appealed.
