Facts
Shaneani Mason was a twenty-five-year-old woman with cerebral palsy and mental retardation caused by suffering strokes as a child due to Sickle Cell Disease. Mason lived with Byndom’s (D) girlfriend Rita who was paid a stipend by the State to help care for Mason as she could not care for herself, stand or move without assistance, or speak without the assistance of a computer augmented speaking device. D was convicted of rape and appealed arguing that the trial court erred in finding Mason competent to testify.
