Facts

Campbell (D) and a co-felon robbed a taxi driver. They were ready to kill the driver when he shot and wounded his co-felon. The co-felon attempted to flee and was shot by a policeman and eventually died of his wounds. D was charged with felony murder and pled guilty. D appealed; he did not kill the co-felon.
