Ps brought a products liability action against Ds for injuries sustained by Phillis Cerrato (P) while using a blender designed and manufactured by D. Ps claim the blender exploded and resulted in hot liquids burning Phyllis and causing property damage. Ps have sued in negligence, strict liability and breach of warranty. On May 1, 2017, P served D with a Second Request for Production of Documents. P requested all accident reports and consumer complaints relating to the product at issue. D objected on various grounds, specifically objecting to producing documents relating to injuries that did not occur under substantially similar circumstances as P's accident. D limited its response to similar accidents. Upon receiving D's production, P filed its Motion to Compel.
