Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Comas (P) sought to compel United Telephone Company of Kansas (D) to produce all information encompassed by Rule 26(a)(1) along with reasonable expenses. P contends that D should produce the personnel files of four individuals whose treatment is at issue, and production of an internal investigative file prepared by D in connection with his previous EEOC charges. P submits that the parties agreed to voluntarily produce all relevant materials as an alternative to formal discovery. D concedes that the parties agreed to furnish copies of all non-privileged documents, rather than describe them and that they have also agreed upon an appropriate protective order for the internal investigation file. D contends that the personnel files of the persons other than P should not be produced in its initial Rule 26(a)(1) disclosures. P asked the court to compel production of unredacted files.
