Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Bohannon (D) and two others picked up a 33-year-old, mildly retarded woman who was hitchhiking. D took her to a sandy pit, where sexual acts occurred. D claimed that she consented, while the woman claimed that she was raped. The woman's complaints were inconsistent, and D sought to introduce evidence of similar inconsistent statements in her past where she claimed that she had been raped. The trial judge disallowed this testimony, D was convicted, and he appealed.
