Facts

Thyng was stabbed three times by Shea (D) and another person. D was arrested and charged with assault with the intent to kill. The trial court instructed the jury but did not clearly indicate that the crimes with which D was charged with required specific intent. D appealed. The appellate court reversed one of the charges (armed assault with intent to murder) and the state supreme court agreed to hear the case.
