Cooper v. Mrm Investment Co.
199 F.Supp.2d 881 (M.D.Tenn. 2002)
Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
Cooper (P) was hired by MRM (D) to work at its Waverly Tennessee KFC. P alleges that while working there, she was sexually harassed by Terry Rogers (D1), one of the owners of D and was then constructively discharged by Ds. P signed a document on employment entitled Arbitration of Employee Rights that required her and KFC to arbitrate. Ds contend that the agreement is one for mandatory arbitration with them. P contends that there was no agreement between her and these defendants and that even if there was it is unenforceable because it requires her to pay a portion of the costs.
