Facts

Cooper (D) got into an argument with his brother, Robert. Robert hit D in the head with a radio. D's mother left for help. She heard a gunshot and returned to find her son fatally shot. D claimed self-defense. The trial court instructed the jury that there was a duty to retreat. D was convicted of manslaughter. D appealed; there was no duty to retreat in his own home.
