Facts

In joint indictments, Ds were charged with robbery of a church rectory and robbery of a home. The first offense was alleged to have occurred on February 23, 1962. The second was alleged to have occurred on May 2, 1962. Both Ds filed pretrial motions for severance of the counts. That was denied. The jury found both guilty of the church robbery but not of the home robbery. Ds appealed.
