Facts

P was the famous Dallas Cowboy Cheerleaders. D made the infamous file, Debbie Does Dallas in which Debbie wanted to become a Dallas Cowgirl, and she and her friends perform a number of sex acts to gain the money necessary for the trip. Debbie spends about twelve minutes clad in a uniform strikingly similar to the official version worn by P. Advertisements referred to her as an X Dallas Cheerleader though she had never been employed by P. P sued under the Lanham Act for trademark violation. A preliminary injunction was granted. D appealed.
